HS SECURES APPELLATE VICTORY IN SECOND CIRCUIT FOR INTERNATIONAL MINING CLIENT

HS scored a win in the Second Circuit Court of Appeals on behalf of an international mining company and its former President and CEO. In 2018, both were sued in for allegedly violating the U.S. securities laws. The court dismissed the case on grounds of international comity – since the company was in the middle of insolvency proceedings in Canada, it found that plaintiffs waived their rights to recover by electing to proceed in New York.  Plaintiffs appealed, and firm partner Andrew St. Laurent and counsel Joseph Gallagher convinced the Court of Appeals to sustain the lower court’s dismissal.
